Non-domestic rates credit balances and empty properties
Information about credit balances and empty properties are exempt under section 31(1)(a) of the Freedom of Information Act 2000.
We no longer publish information about business rates accounts that have credit balances in response to Freedom of Information (FOI) requests. This is because disclosing it could result in fraudulent refund claims.
This follows a decision of the Information Commissioner's Office (ICO) on 6 February 2017. The decision was about an FOI request for national non-domestic rates (NNDR) credit balances.
We no longer publish information about business rates empty properties in response to FOI requests. This is because disclosing it could result in disclosing vacant properties that leaves them vulnerable to criminal damage and activity.
When we engage section 31 of the Freedom of Information Act, we must consider public interest.
We have considered that it is in the public interest that we:
- make sure our business is transparent and efficient
- prevent fraudulent refund claims, costing public money
- contribute to sum of criminal knowledge
- protect from crime and its consequences
We feel that preventing fraud and criminal activity outweighs disclosing information about credit balances and empty properties.
