The leisure facility

The "leisure facility" refers to any Lifestyle Active leisure facility managed by Dorset Council.

Memberships

Membership cards are issued to all current members and must be shown at the leisure centre reception to gain entry every time a visit is made to the leisure centre. Membership cards may only be used by the registered member and any fraudulent use of the membership card by the member will result in cancellation of that membership with no refund being made by the council.

Lost or damaged membership cards may be subject to a replacement charge being made by the council. Your photograph will be taken on your first visit to the centre and will be retained indefinitely unless otherwise requested.

If your bank details or contact details change, please inform us immediately. Failure to do so may result in your membership being suspended and access to the facilities refused.

Initial payment will be made by cash, cheque, credit or debit card. The amount payable will be pro rata the standard monthly fee dependent on the number of days until your first direct debit payment.

Direct Debit membership

Payments will continue to be drawn direct from your bank on the first of each month until the leisure facility is instructed otherwise by the account holder.

The non-payment of a Direct Debit will automatically render your membership invalid.

To cancel your membership please contact the applicable leisure site and provide written confirmation of your intention to cancel. A full calendars months' notice is required and once your last direct debit has been taken it is your responsibility to cancel it with the bank. No refund will be given for payments already taken.

Membership joining fees and Direct Debit monthly fees may be altered at any time, members will be notified in writing of any changes to fees payable by Direct Debit.

Direct Debit instructions are not accepted on bank accounts for customers under the age of 16yrs. These customers must provide the account details of their parent/guardian who must sign the mandate as acceptance of the terms and conditions

Monthly membership charges

The member is liable to pay all monthly membership/course fees irrespective of actual usage of the leisure facilities, (this may include a pro-rata fee up until the first Direct Debit payment collection date). Subsequent monthly fees are payable in advance by Direct Debit which will be collected on or just after the first of each month.

All correspondence must come from the member associated with making the membership payment.

An additional pro-rata payment may be required when an upgrade is completed. This will be automatically worked out by the computer system, and will be payable at the time of upgrade.

Suspension or freezing of memberships will be at the sole discretion of the Senior Management Team.

For bookable activities, Platinum members can book 10 days in advance and Priority members 7 days in advance. Only one court can be booked per membership at any one time. The person booking the facilities must be present. Payment is made when you use the facilities unless otherwise stated.

For activities included in membership, members are required to give a minimum of 24 hours notice to cancel a class or court booking.

Members will be charged full non members rate for all bookings which are not cancelled within the required time frames.

In order to protect the security of membership cards it will be necessary to have your photograph taken and stored on the membership database. This is for internal use only and enables us to protect your card against misuse.

Annual membership

These will run for a period of 12 months from the date of commencement. No refunds can be given if you terminate your membership before the expiry date.

Limitation of liability

The member acknowledges that the council's obligations and liabilities in respect of the leisure centre are exhaustively defined in this agreement.

The member is responsible for the consequences of any use of any of the services of the leisure facility. The council will not be liable for any indirect or consequential loss, damage, costs, expenses, theft or damage to property, whether arising under contract, tort (including negligence) or otherwise.

The council accepts liability to the extent that it results from the negligence of the council and its employees for death or personal injury without limit.

Access to facilities and activities will be as per the operating times and programme listed within each leisure facilities brochure.

The council reserves the right to amend its activity programme to meet customer demand.

The council may at any time, withdraw all or part of the facility for any period or

periods of time, and with or without notice in connection with any major events, cleaning repairs, alterations or maintenance work, or for any reason beyond their control.

Members must be aware of and comply with the parking restrictions within all car parks.

Members are expected to use the facilities in a responsible and safe manner and must ensure that they adhere to the General Rules and Conditions of Use displayed within each leisure facility. The council reserves the right to make any reasonable changes to these rules at any time.

Physical health of member

The member warrants and also represents that they are in good health and are not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well being or physical condition.

Before using any leisure centre facilities the member must read and comply with the health commitment statement. Those using the Fitness Studios will be required to sign the statement prior to using the facilities.

All members wishing to use the Fitness Studio must partake in an induction at either one of the leisure sites with a member of staff prior to their first solo use.

Members wishing to use the Verwood Hub fitness studio will pay a charge of £7.50 for the Wellness Key and will require a half hour induction prior to solo use.

Members must inform the leisure facility of any changes of the information originally supplied on the exercise and health questionnaire.

Members must inform the leisure facility of any change of address immediately.

Assignment

The council may assign the benefit of these terms and conditions of membership to a third party on similar terms and conditions without notice being served upon the member to that effect.

Expulsion of members or termination of membership by the council

The council may expel members or may terminate the membership of any member:

  • without notice and with immediate effect if the member's conduct, whether or not such conduct is the subject of a complaint by another member or group of members, is such that in the reasonable opinion of the council, it may be injurious to the character, name or interests of the leisure centre or is such that it renders the member unfit to associate with other members of the leisure facility
  • forthwith and without notice if the member shall have committed any breach of these terms and conditions or of the rules, bylaws and regulations of the leisure centre which are in force from time to time
  • upon not less than thirty days notice in writing if the council is of the opinion that the member is not a suitable individual for continuous membership of the leisure facility
  • lapses in membership/course payment may result in the member not being allowed to use the leisure facilities until payment is made

A member whose membership is terminated by the council shall forfeit all privileges of membership with immediate effect without an entitlement to any claim for any refund of their membership fee. On termination of their membership, the member shall return forthwith their membership card.

Leisure facilities

Certain categories of membership do not include all of the Leisure facilities services. Services and facilities not so included may be provided at an additional charge at the council's discretion.

The council reserves the right to make reasonable alterations to the type of facilities provided without notice and the council shall not be liable for any inconvenience caused by building works and for the provision of essential maintenance services.

We reserve the right to cancel fitness classes and activities and close facilities without prior warning or notice where reasonable .

Data Protection Legislation

The information you provide will be used to process your membership application. The council may wish to advise you about other similar services or facilities that it is able to offer from time to time
